1. 동의와 이용 자격

본 약관은 PungPung Studio(이하 “운영자”)가 제공하는 Midnight Letter 앱과 관련 서비스에 적용됩니다. 서비스를 사용하면 본 약관과 개인정보처리방침에 동의한 것으로 봅니다. 서비스는 만 18세 이상만 이용할 수 있습니다.

2. 게스트 및 연결 계정

로그인 없이 게스트로 체험할 수 있으며, 기록 보관과 기기 간 동기화를 위해 Apple 또는 Google 계정을 선택적으로 연결할 수 있습니다. 연결하지 않은 게스트 계정은 앱 삭제, 기기 교체·분실 또는 앱 데이터 초기화 시 복구하지 못할 수 있습니다.

3. AI의 성격과 한계

캐릭터와 답변은 AI가 생성하는 가상 콘텐츠이며 실제 사람, 의식 있는 존재 또는 전문 상담사가 아닙니다. AI는 부정확하거나 불쾌하거나 예상하지 못한 답을 만들 수 있습니다. 서비스는 심리치료, 의료·법률·금융 자문이나 긴급 구조를 제공하지 않습니다. 위기나 즉각적인 위험이 있으면 현지 응급기관 또는 자격 있는 전문가에게 연락해야 합니다.

4. 이용자 콘텐츠와 라이선스

이용자는 자신이 입력한 메시지·설정 등 콘텐츠의 권리를 유지하고, 필요한 권리를 보유한 콘텐츠만 제공해야 합니다. 이용자는 서비스 제공, AI 답변 생성, 저장·동기화, 안전 검사, 신고 처리와 오류 해결에 필요한 범위에서 운영자와 처리업체가 해당 콘텐츠를 처리할 수 있는 비독점적 라이선스를 부여합니다. 이는 콘텐츠 소유권 이전이 아닙니다.

5. 금지 행위

• 아동 성착취, 비동의 성적 콘텐츠, 실제 인물의 성적 딥페이크 또는 불법 성적 콘텐츠 생성·공유
• 자살·자해 조장, 테러·폭력 선동, 혐오, 착취, 괴롭힘, 스토킹, 신상 공개 또는 타인 위협
• 사칭·사기, 개인정보·저작권·초상권 침해, 악성코드, 범죄 실행 지원
• 안전장치·사용량 제한 우회, 무단 자동화, 역공학, 계정 거래 또는 서비스 방해

6. 요금, 변경과 이용 종료

선택형 월간 구독과 소모성 추가 이용권은 App Store 또는 Google Play 인앱결제로 판매됩니다. 구매 화면에는 실제 현지 가격, 제공량과 결제 주기를 표시합니다. 구독은 스토어 계정으로 자동 갱신되며 다음 갱신 전에 스토어 구독 설정에서 해지할 수 있습니다. 환불은 각 스토어 정책과 관련 법령을 따릅니다. 계정 삭제만으로 구독이 자동 해지되지는 않습니다. 운영자는 안전·법률·기술·운영상 필요한 경우 기능을 변경하거나 접근을 제한할 수 있으며 중대한 변경은 합리적인 방법으로 알립니다.

7. 책임과 준거법

법이 허용하는 범위에서 서비스는 현재 상태로 제공되며 지속성, 특정 결과 또는 AI 답변의 정확성을 보장하지 않습니다. 운영자의 고의·중과실 또는 강행법규가 달리 정하는 경우를 제외하고 간접·특별·결과적 손해에 대한 책임은 제한됩니다. 본 약관은 대한민국 법률을 따르되, 이용자의 거주지에서 배제할 수 없는 소비자 보호 권리는 그대로 유지됩니다.

1. Acceptance and eligibility

These terms apply to the Midnight Letter app and related services provided by PungPung Studio (“we”). By using the service, you agree to these terms and the Privacy Policy. You must be at least 18 years old.

2. Guest and connected accounts

You may try the service as a guest without signing in and optionally connect Apple or Google to preserve records and sync across devices. An unconnected guest account may be unrecoverable if you delete the app, replace or lose the device, or clear app data.

3. Nature and limits of AI

Characters and replies are virtual content generated by AI. They are not human, conscious, or licensed counselors. AI may produce inaccurate, upsetting, or unexpected output. The service is not therapy, medical, legal, or financial advice, and it is not an emergency service. Contact local emergency services or a qualified professional when there is immediate danger or a crisis.

4. Your content and license

You keep your rights in messages, settings, and other content you submit and must have the rights needed to submit it. You grant us and our processors a non-exclusive license limited to providing the service, generating AI replies, storing and syncing data, performing safety checks, handling reports, and resolving errors. This does not transfer ownership of your content.

5. Prohibited conduct

• Child sexual exploitation, non-consensual sexual content, sexual deepfakes of real people, or illegal sexual content.
• Promoting suicide or self-harm, terrorism, violent incitement, hate, exploitation, harassment, stalking, doxxing, or threats.
• Impersonation, fraud, privacy, copyright or publicity-right violations, malware, or assistance with crime.
• Bypassing safeguards or usage limits, unauthorized automation, reverse engineering, account trading, or service disruption.

6. Charges, changes, and termination

Optional monthly subscriptions and consumable extra packs are sold through App Store or Google Play in-app purchase. The purchase screen shows the actual local price, included allowance, and billing period. Subscriptions automatically renew through your store account and may be cancelled in store subscription settings before the next renewal. Refunds follow store policy and applicable law. Deleting your account does not automatically cancel a subscription. We may change features or limit access when reasonably necessary and will give reasonable notice of material changes.

7. Liability and governing law

To the extent permitted by law, the service is provided as is, without a promise of uninterrupted availability, a particular outcome, or accurate AI output. Except for willful misconduct, gross negligence, or liability that cannot legally be limited, we limit liability for indirect, special, or consequential losses. Korean law governs these terms, while mandatory consumer rights in your place of residence remain unaffected.

利用規約 — 日本語

1. 同意と利用資格

本規約はPungPung Studio（以下「当社」）が提供するMidnight Letterアプリおよび関連サービスに適用されます。利用により、本規約とプライバシーポリシーに同意したものとみなします。18歳以上の方のみ利用できます。

2. ゲスト・連携アカウント

ログインせずゲストとして体験でき、記録保存と端末間同期のためAppleまたはGoogleを任意で連携できます。未連携のゲストアカウントは、アプリ削除、端末交換・紛失、アプリデータ消去により復元できない場合があります。

3. AIの性質と限界

キャラクターと回答はAIが生成する仮想コンテンツであり、実在の人物、意識を持つ存在、資格を有するカウンセラーではありません。不正確、不快、予期しない出力を生成する場合があります。本サービスは心理療法、医療・法律・金融助言、緊急対応ではありません。危機や差し迫った危険がある場合は、地域の緊急機関または専門家へ連絡してください。

4. 利用者コンテンツとライセンス

利用者は入力したメッセージ・設定等の権利を保持し、必要な権利を有するコンテンツのみ提供するものとします。サービス提供、AI回答生成、保存・同期、安全確認、通報対応、障害解決に必要な範囲で、当社と処理委託先に非独占的な処理権限を付与します。所有権は移転しません。

5. 禁止行為

• 児童の性的搾取、同意のない性的コンテンツ、実在人物の性的ディープフェイク、違法な性的コンテンツ
• 自殺・自傷の助長、テロ、暴力扇動、憎悪、搾取、嫌がらせ、ストーキング、個人情報晒し、脅迫
• なりすまし、詐欺、プライバシー・著作権・肖像権侵害、マルウェア、犯罪支援
• 安全機能・利用制限の回避、無断自動化、リバースエンジニアリング、アカウント売買、サービス妨害

6. 料金、変更、終了

任意の月額購読と消耗型追加パックは、App StoreまたはGoogle Playのアプリ内課金で販売します。購入画面に実際の現地価格、提供量、請求期間を表示します。購読はストアアカウントで自動更新され、次回更新前にストアの購読設定から解約できます。返金は各ストアの方針と適用法令に従います。アカウント削除だけでは購読は自動解約されません。重要な変更は合理的な方法で通知します。

7. 責任と準拠法

法令の許す範囲で、サービスは現状有姿で提供され、継続提供、特定結果、AI出力の正確性を保証しません。故意・重過失または制限できない法的責任を除き、間接・特別・結果的損害に対する責任を制限します。韓国法を準拠法としますが、居住地の強行的な消費者保護権は影響を受けません。
